§ 26. Special Assessment Proceedings

  • (a) In addition to all other powers granted under this act, the district may acquire, construct, complete, and maintain any improvements if the improvements are authorized by special assessment proceedings or special tax proceedings, or both.

    (b) The Mello-Roos Community Facilities Act of 1982 (Chapter 2.5 (commencing with Section 53311) of Part 1 of Division 2 of Title 5 of the Government Code, the Improvement Act of 1911 (Division 7 (commencing with Section 5000) of the Streets and Highways Code), the Improvement Bond Act of 1915 (Division 10 (commencing with Section 8500) of the Streets and Highways Code), and the Landscape and Lighting Act of 1972 (Division 15 (commencing with Section 22500) of the Streets and Highways Code) are applicable to the district and the powers, and duties conferred by those acts may be exercised by the district.

    (c) The improvements authorized to be constructed or acquired by this section are limited to those permitted to be constructed or acquired by the district under the provisions of this act.
